Land Rentcharge

North Huyton Communities Future (NHCF) is responsible for the administration of a Community Rentcharge which was registered on a substantial number of new build properties within the North Huyton Revive development scheme.

If your property is subject to the Community Rentcharge, the title to the property will contain a restriction which does not allow the property to be sold or the subject of a remortgage without confirmation from NHCF that no part of the Community Rentcharge is outstanding.

The position is that the Community Rentcharge has never in fact been levied so no sums are owing, nor will a request be made for payments in the future.

In the circumstances, you may as the owner of the property or your solicitor on your behalf, contact Tim Molton who is the relevant officer of NHCF requesting correspondence confirming that the relevant clause has been complied with. NHCF does not currently charge for this service.

If you as the owner, require the clause removing completely from the title, NHCF are content to enter into a Deed of Mutual Release which once granted will remove the arrangements regarding the Community Rentcharge, including the restriction on title to the property.

If you wish to take this route, your solicitor should arrange to contact Anne-Marie Williams at Taylor Rose who are NHCF’s solicitors and are based in Warrington. If your solicitor contacts Taylor Rose, they will be advised of their requirements regarding the drafting of the Deed of Mutual Release which will include the payment of their fees and a charitable contribution to NHCF.
